Re: Liberty on Bluff Creek Storm Sewer Replacement Cost Sharing
Dear Shawn:
The City of Chanhassen is in receipt of check number 24618 from K.
Hovnanian Homes in the amount of $6,134.00.
It was not prudent at this time to cooperate with the Deglers to complete the
work requested in Special Condition "Z" of the Liberty on Bluff Creek 2nd
Addition Development Contract:
"The grade stabilization structure at the north end of Basin A is in
disrepair and shan be replaced. . Before the development incorporates this
structure into the'permanent storm water rnanagement system, the
structure shall be assessed and a plan proposed and approved by the city
for the repair or replacement of the structure, as well as long term
maintenance. The applicant shall work with the property owner to the
north to get permission to repair orreplace the structure."
The City will utilize the funds tohirea contractor to complete the entire repair
or will reimburse the developer of the Degler property for completion of.
Liberty on Bluff Creek'sportionofthe work, if it is completed in conjunction
with that project. Therefore, payment for K. Hovnanian Homes' portion of
the design and construction costs satisfies Special Condition "Z" of the
Libert yon Bluff Creek 2nd Addition Development Contract, as stated above.
